A writ petition has been filed challenging the legality of holding national election and referendum on the same day.
It sought a stay order on the effectiveness of the gazette notification issued on December 11 on the schedule for both the parliamentary election and the referendum on a single date.
Supreme Court lawyer Adv Md Eunus Ali Akond submitted the petition on Monday.
In the writ, Eunus Ali also sought a directive to form a non-party caretaker government and hold the national parliamentary election within 90 days under such an administration.
The Law Secretary, the Chief Election Commissioner and the Returning Officer of Dhaka have been made respondents in the writ.
The lawyer said the Constitution does not mention any provision for an interim government and therefore no election can be held under such an administration. He said elections can only be conducted under a caretaker government or an elected government. Eunus Ali Akond further added, while the Constitution mandates the holding of parliamentary elections there is no constitutional or Representation of the People Order provision for holding a referendum, prompting the filing of the writ.
